PayDart is democratizing accepting digital payments by making sellers over the internet offer comprehensive payment options to their payers through a single integration! PayDart is an end to end payments platform that makes the transactions over the internet safe, secure, and easier than ever. While we believe the free and open exchange of ideas and products is a key tenet of commerce, there are some activities that are incompatible with PayDart’s mission to make digital payments better & accessible for everyone. This Terms of use policy (“TOU”) describes activities that are prohibited in connection with your use of the Services . PayDart may modify this TOU, at any time by the modes including but not limited to posting a revised version at its website or by sending an email. By continuing to use the Services or access your Account after a revised version of the TOU has been posted, you agree to comply with the latest version of the TOU. In the event of any conflict between this TOU will take precedence, but only to the extent required to resolve such a conflict.
We may, at any time and without notice, remove any Materials, and suspend or terminate your Account or your access to the Services if you engage in activities that violate the letter or spirit of this TOU, including activities outside of your use of the Services.
PayDart has the right, but not the obligation, to monitor or investigate any Materials and your use of the Services at any time for compliance with this TOU, or any other agreement between you and PayDart governing your use of the Services (collectively, the “Terms of Use”). Our determination of whether a violation of this TOU has occurred will be final and binding, and any action taken with respect to enforcing this TOU, including taking no action at all, will be at our sole discretion.
As part of PayDart’s TOU, you agree not to use the information, Services or any other part of PayDart to take any action(s) that:

Are contrary to PayDart’s or its suppliers public image, goodwill or reputation;

Promote any illegal activity or content, including without limitation child or animal exploitation or abuse, violence, illegal drug use, and underage drinking;

Infringe on our or any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;

Express or imply that any of your statements, activities or causes are endorsed by us, without our prior written consent in each instance;

Violate any applicable law, statute, ordinance or regulation, or encourage any conduct that could constitute a criminal offense or give rise to civil liability;

Are libelous, defamatory, threatening, harassing, abusive, tortious, pornographic or obscene;

Promote or condone hate or violence against people based on race, ethnicity, color, national origin, religion, age, gender, gender identity, disability, medical condition or other forms of discriminatory intolerance. Promote or support organizations, platforms or people that: (i) promote or condone such hate; or (ii) threaten or condone violence to further a cause;

Offer goods or services, or post or upload Materials, that contravene or that facilitate or promote activities that contravene, the laws of the jurisdictions in which you operate or do business. “Materials” means any photo, image, video, graphic, written content, audio file, code, information, data or other content uploaded, collected, generated, stored, displayed, distributed, transmitted or exhibited on or in connection with your Account;

Transmit any trade secret or other material, non-public information about any person, company or entity without the authorization to do so;

Restrict or inhibit any other visitor from using the PayDart Services, including, without limitation, by means of “hacking” or defacing any portion of the PayDart Services;

Modify, adapt, sub-license, translate, sell, reverse engineer, decompile, or disassemble any portion of the PayDart Services;

Remove any copyright, trademark, or other proprietary rights notices contained in the PayDart Services;

Sublicense, sell, rent, lease, transfer, assign, or convey any rights under the Terms of Use to any third party, or otherwise commercially exploit or profit from the information or content of the PayDart Services, or any portion thereof, in any manner whatsoever, except as expressly permitted herein;

“frame” or “mirror” any part of the PayDart Services;

Distribute any virus, worm or other similar or deleterious files, scripts or programming routines;

Transmit malware or host phishing pages, perform activities or upload or distribute Materials that harm or disrupt the operation of the Services or other infrastructure of PayDart or others, including PayDart’s third party providers. You may not use the Services for deceptive commercial practices or any other illegal or deceptive activities;

Interfere with or disrupt any services or equipment with the intent of causing an excessive or disproportionate load on the infrastructure of PayDart or its licensors or suppliers;

Offer goods or services, or post or upload Materials, that imply or promote support or funding of, or membership in, a terrorist organization;

Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, “data mine,” crawl or scrape the PayDart Services or in any way reproduce or circumvent the navigational structure or presentation of the PayDart Services or its contents, authentication and security measures;

Forge headers or otherwise manipulate identifiers in order to disguise the origin of any submission;

Execute any form of network monitoring or run a network analyzer or packet sniffer or other technology to intercept, decode, mine or display any packets used to communicate between PayDart’s servers or any data not intended for you;

Harvest or collect information about any PayDart visitors or members without their express consent; and/or
-
Contains any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence;

Use or access the Services to build a competing service.
